Guild Wars Auctions Terms of Use

By clicking "Yes, I accept" as part of the registration process, you (the "user") agree to the Terms of Use (the "terms") described below for the purpose of using the services provided by the Guild Wars Auctions website (the "site"), and you acknowledge that you have fully read, understood and accepted these terms.

You also acknowledge and accept that the Guild Wars Auctions website is a form of unofficial fansite with no affiliation or relationship to Arenanet® or NCsoft corporation.

Terms of Service:

1. The site may only be used for the purpose of trading game items relating to the Guild Wars^TM game for the virtual currency of Guild Wars Gold or Ectoplasm.

2. In using this site, you must abide by the rules as defined by Arenanet® in the Guild Wars User Agreement and associated Rules of Conduct as described on the official Guild Wars website. These rules include, but are no limited to, the prohibition of trading or promoting any item on this site for real-world money.

3. You are not permitted to sell game related content, derivative works or game account access keys and you accept that doing so will result in a swift and permanent termination of your account on this site.

4. You confirm that the information you have provided in your registration is both accurate and valid, including your email address and your in-game character name. 

5. If any information provided in your registration is subsequently found to be false, you accept that our moderators have the right to remove your account from the site.
   

6. You accept that the services provided by the site are for non commercial purposes and are provided free of charge to all registered users.

7. You agree that if the services offered to you by this website are suspended, terminated or cancelled for any reason or length of time, you are not entitled to any compensation or associated damages.

8. You acknowledge and accept that it is your responsibility to ensure the completeness, authenticity and truthfulness of any information included in the listings you place on our site.

9. You accept that placing a listing on the site represents a valid offer of sale and you are required to honour that offer to the winning bidder.

10. You acknowledge and accept that you may only withdraw or modify the content of a listing you have placed prior to the first bid being placed on that listing.
    

11. Artificial bidding on your own listings, via the use of another account, is not permitted on this site and the site automatically monitors for such attempts. You accept that being party to artificial bidding will result in a permanent termination of your account on this site.

12. You accept that it is your responsibility and obligation to ensure transactions between yourself and other users are completed for an amount equal to the winning bid for that listing once the auction has closed.

13. For removal of doubt, a "winning bid" in a standard auction is defined as the last bid placed on a listing before that listing closed, if that bid equaled or exceeded the listed reserve.

14. You accept that placing a bid on a listing constitutes a binding agreement within the terms of this site and such a bid is irreversible.

15. You agree to only use this site for its intended purpose and will obey any and all rules imposed by the Guild Wars Auctions administrators, whether such rules are existing at the time of your registration or added subsequently.

16. You acknowledge and accept that the use of any obscene or offensive material on this website will not be tolerated and may result in permanent termination of your account on this site.

17. You acknowledge and accept that any attempt by you to willfully harm or compromise the integrity of the site or its database will result in a permanent ban of your account, IP address, associated IP addresses, followed by legal action.

18. You acknowledge and accept that any attempt by you to impersonate the administrators or moderators of this site, whether intentionally or otherwise, will result in swift and permanent termination of your account. This also extends to claiming false affiliation to any administrator or moderator of the site.

19. You agree to receive automated notification emails from the administrators relating to the auctions you take part in as either a buyer or seller.

20. You agree and accept that "ignorance" will not be accepted as an excuse for breach of the above terms.

Limitation of Service and Liability:

1. You accept that the Guild Wars Auctions website and its administrators will not enter into discussions with buyers or sellers about 'scams' that take place in game as part of settling a transaction once it has concluded on this site.

2. You acknowledge and accept that the site has no responsibility to settle or resolve issues between buyers and sellers in relation to trade transactions made within the Guild Wars game itself and you release the site from any and all responsibility for such transactions between yourself and other users.

3. You acknowledge and accept that the site is not responsible for validating the authenticity or truthfulness of any information in listings presented by our users, and that the site is not a legal auction house.

4. You accept that Guild Wars Auctions or the administrators are not responsible for any damage or harm caused by following external links contained in this site. We commit to removing such harmful links as soon as we are notified, however we take no responsibility for damage or harm caused once you leave this site.

The Guild Wars Auctions website hereby acknowledges that the Guild Wars related content (including images, text, animations, sound files, general game content, or derivative works) represented within this site are the legal property of NCSoft Corporation, and the following trademark designations are notice of this ownership:
